摘 要:近年来，由于房租过高导致一个人或一个家庭难以承担，以各种类型组成的住宅拼租现象日趋流行，住宅拼租的概念也渐渐融入了现代人的生活方式中，矛盾纠纷的发生也表明有必要研究其法律关系。本文主要根据现有关于拼租的概念及缺陷和国外对于多人拼租的习惯与规制，着重提出符合我国现存多人租赁市场特色的拼租的定义及特征。拼租的特殊性主要涉及到的，包括不定数量的租赁关系导致了出租人与拼租人之间、各拼租人之间产生了异于传统租赁的多种法律关系以及需要约束的法律内容也与传统租赁不同。故通过拼租与整租、转租的辨析，分析其区别与联系，并在这个基础上讨论了现下的房屋租赁习惯对拼租的认可度。最后对拼租的构成要件在合法性角度进行分析，讨论拼租的合法性以及其应当依据的租赁法律规范等，对多人租赁产生的纠纷的解决起到了一定的帮助，促进了租赁市场的发展。
Abstract:In recent years, a person or a family being hard to bear high rents, a variety of types of housing rent phenomenon has become increasingly popular. The concept of residential shared also gradually into the modern way of life, disputes occur also suggests that it is necessary to study its legal relationship. The current concepts and defects about the shared are compared for the United States, France, Germany. According to the habit of shared rent and regulation, our country existing many rental market characteristics of the definition and characteristics of shared. The various legal relationships between the leaser and the lessees , the lessees and the lessees involes the leasehold relation variable number because of the particularity of shared, so constraints of content is different from traditional lease, and the recognition of the lease is discussed on this basis. Finally, by analyzing the components of the rent in the legitimacy is analyzed, discuss together the legitimacy of the rent and the rent shall be based on legal norms, etc., for many people rent has played a certain help to solve the dispute.
