论我国环境公益诉讼

摘要：随着社会的高度发展和科技的进步，与之而来的是以环境的损害为代价，而环境也渐渐开始被人们所重视。在中国由于环境法起步比较晚所以出现环境问题时常常通过传统的行政管理解决，而忽视了先进的环境公益诉讼制度，与之相反，国外的环境之所以污染较少，也正因为其环境公益诉讼制度的高度发展与普及。为了研究我国环境公益诉讼制度目前的状况，写了这篇文章。

本篇文章就是要讨论环境保护法中一个重要的制度，环境公益诉讼制度。首先本文对环境法与环境公益诉讼的一些基本概念进行了阐述，分析了环境公益诉讼的本质特征与含义。随后研究外国先进的环境公益诉讼制度，再与我国目前环境公益诉讼的发展作比较，通过比较不难发现在国外环境公益诉讼的制度已经具体成型，并有了高度的发展，这就为我国的环境公益诉讼制度提供了宝贵经验，我们可以通过这研究，找出他们的相同点也就是值得我们学习的地方。最后我也根据这一次的探讨与研究提出了一些对我国环境公益诉讼有利的建议。
