摘 要:《物权法》以立法的形式确定了不动产登记制度,以登记作为不动产物权变动的公示方式,从而为不动产物权归属及物权变动效力提供依据。而在客观情况下,往往会不可避免的出现通过正当的交易行为已实际取得不动产物权,而尚未依法办理不动产物权变动登记的事实物权。事实物权与法律物权相对应,实践中二者的冲突并不少见,学界对于事实物权也尚未形成统一的定论。但,不可否认的是,不论是事实物权还是法律物权其都有受法律保护的必要性。两大法系各主要国家对此形成了各自的司法保护特色,我国也在司法实践过程中区分涉及第三人利益与不涉及第三人利益的交易场合对事实物权形成不同程度的保护。
The property law establishes the property registration system in the form of legislation, registration is used to prove the change of property, then provides the basis for the estate property and the effectiveness about the property change. But in an objective case, inevitably there will be the property has been obtained by fair trade, but have not handle the registration about change of property. The true property right is relative to the legal property rights, there is not uncommon for conflicting about them in practice, and there are not a unified conclusion in the academic circle. But, there is no doubt that it’s necessary to protect the true property right and the legal property rights. The major countries of two law systems had formed their Characteristics of judicial protection. In the course of judicial practice, our country distinguish between a trading situation involving a third party and a trading situation that does not involve a third party then forming different levels protection.
