摘要：转化型抢劫罪是对人身和财产所进行的双重侵犯，其符合一般抢劫罪的构成要件，但是转化型抢劫罪相比较一般抢劫罪的犯罪构成更为复杂，而且对于转化型抢劫罪我国的法律规定的并不十分细致，这就比较容易引起争议，从而导致学界对该罪的某些方面存在较大的分歧，因此深入探究转化型抢劫罪的认定问题就具有十分重要的意义。我国刑法学界的一些学者对于转化型抢劫罪的定罪问题进行了大量的研究，却鲜有学者对量刑方面的问题进行探讨，这就容易导致对于司法实践中的一些具体问题无法得到同案同判的现象，同样也会导致司法的不公甚至会引起广泛的社会舆论使得案件处于被动状态。

The Identification of Transformed Robbery and Its System Reconstruction

Abstract：Transformative robbery is double violation which carries on to the personal and property, it conforms to the general constitutive requirements of robbery, but transformative robbery compared with general robbery crime constitution is more complex, and on the transformative robbery law in our country is not very careful, this is more contentious, resulting in academic circles there are many differences in certain aspects of this crime.Further study of the cognizance of transformative robbery has very important significance.Some scholars of criminal law educational world for a transformative robbery conviction problem carried out extensive research, but few scholars of sentencing issues were discussed, it is easy to cause for some specific problems in the judicial practice could not get connection with convicted phenomenon, also leads to the judicial injustice, even can cause a wide range of social public opinion made the case in a passive state.
